The President signed the amendment to the Renewable Energy Sources Act (draft UD332) on 15 October 2026 and it appeared in Dziennik Ustaw 2026, item 1347, on 16 October (Sejm vote 4 September, Senate 24 September).
The headline change for prosumers is the end of the 1:1 rule for summing PV and storage power. From 1 December 2026 a distribution operator will not add battery power to the micro-installation's capacity if storage power does not exceed 2.2 times the PV power and combined export from PV and storage is limited to the PV power. A 5 kW array may therefore work with an 11 kW battery system and keep its simplified connection and 5 kW export limit; pending notifications with storage are covered too. The act also treats storage linked to RES generation as a RES installation, clarifies the prosumer deposit on invoices and its return when changing seller, and amends installer certificate rules.
For installers: for systems commissioned after 1 December 2026, keep storage power at or below 2.2 x PV power, document the export limitation in the grid-operator notification, and be ready to supply storage data for pending applications.
